The Department of State Services on Monday failed to present the leader of the Indigenous People of Biafra, Nnamdi Kanu, in court as scheduled.
The development stalled the arraignment of the IPOB leader after he was rearrested on the 29th of June.
During the sitting, counsel to the federal government M.B Abubakar, made an observation that the presiding Judge Justice Binta Nyako, cannot continue with the case as the court is on vacation.
He also said that there is no fiat from the chief Judge to continue the matter.
Nnamdi Kanu’s counsel, Ifeanyi Ejiofor, noted that he was not put on notice by the prosecution and do not know why the defendant is not in court.
The court was later informed that the DSS could not produce the defendant in court due to logistic reasons.
The court ordered that the matter be adjourned to the 21st of October.
The court also denied the defence counsel’s application to transfer Nnamdi Kanu from DSS custody to Kuje correctional center.
